Terms of Service

1. Introduction

These Terms of Service (“Terms”) govern your access to and use of the HubDub platform, coaching programmes, consultancy engagements, and any related materials, interactions, or deliverables (collectively, the “Service”) provided by James Craig Consultancy t/a HubDub (“HubDub”, “we”, “our”, or “us”).

By registering for, accessing, purchasing, or using any part of the Service, you (“User”, “Client”, “you”) agree to be bound by these Terms. If you do not agree, you must not access or use the Service(s).

2. Definitions

  • Service – Includes the HubDub digital platform, coaching services, consultancy services, training, strategy sessions, workshops, and any associated materials or communications.
  • Coaching Services – Guidance, support, mentoring, frameworks, or training delivered individually or to groups, whether online or in person.
  • Consultancy Services – Professional advice, strategic recommendations, planning, or project delivery provided by HubDub.
  • Deliverables – Any documents, plans, frameworks, reports, or outputs provided during consultancy or coaching engagements.
  • Account – The user profile created to access the software component of the Service.
  • Administrator – A person or organisation managing a HubDub software account.
  • Content – Any data, files, or materials uploaded or transmitted within the software or shared with HubDub during coaching/consultancy engagements.

3. Eligibility

To use the HubDub software, coaching, or consultancy services, you must: • Be at least 18 years old; • Have authority to enter into contracts on behalf of yourself or your organisation; • Provide accurate registration or engagement information.

HubDub may refuse or terminate access to any part of the Service if eligibility criteria are not met.

4. Account Registration and Security

You are responsible for maintaining the confidentiality of your login credentials and all activity under your account.You must promptly notify HubDub of any unauthorised access or suspected breach.

HubDub shall not be liable for any loss or damage resulting from failure to safeguard your credentials.

5. Scope of Service

a. Software Platform

A digital platform built on GoHighLevel that enables users to manage websites, communications, automation, CRM, booking flows, and related marketing operations. HubDub does not access or process end-client data unless expressly granted temporary access for support purposes.

b. Coaching Services

Coaching may include strategic guidance, accountability support, operational advice, mindset or performance frameworks, and recommendations. Coaching does not guarantee outcomes and does not replace professional legal, financial, psychological, or medical advice.

c. Consultancy Services

Consultancy may include audits, strategy development, commercial advisory, process mapping, training, documentation, and implementation guidance. Consultancy advice is based on information provided by the Client; execution and decision-making remain the Client’s responsibility.

d. Right to Modify Services

HubDub may update, enhance, or discontinue aspects of the Service with reasonable notice where practicable.

6. Payment and Billing

All fees are payable in advance as specified during registration or upgrade.

a. Subscription ChargesFees for monthly or annual subscriptions are charged automatically to the payment method on file via Stripe. Invoices can be issued upon request at jc@jamescraigconsultancy.com

b. Refund PolicyRefunds may be requested within 14 days of initial purchase, provided the account has not been actively used to access or deploy the Service. See the Refund & Cancellation Policy for full terms.

c. Price ChangesHubDub reserves the right to modify pricing with at least 30 days’ prior notice to active subscribers.

d. Payment Details for Trial Period

Payment details may be requested during sign-up to help ensure a seamless transition, but no charges will be applied during the trial period.

e. Limitation of Liability (Trial Period)

Services provided during the free trial are offered “as is”. HubDub is not liable for any loss, damage, or business impact arising from use of the platform during the trial period.

f. Automatic Conversion to Paid Plan

If the client does not cancel before the trial expires, the service will automatically convert into the selected paid plan and the applicable fees will be charged. Clients are notified before this conversion occurs.

g. Coaching and Consultancy Fees

Fees for coaching or consultancy programmes, retainers, sessions, or project work will be agreed in writing before engagement. Payment may be required upfront or in staged instalments.

h. No Guarantee of Business Outcomes

HubDub provides guidance and recommendations but cannot and does not guarantee specific business results, revenue outcomes, or performance improvements.

7. Term and Termination

These Terms remain in effect until your account is cancelled or terminated.

a. By You: You may cancel your subscription at any time via your account settings or by contacting support.

b. By Us: We may suspend or terminate access immediately if you:

  • Breach these Terms;
  • Use the Service unlawfully or fraudulently;
  • Fail to make timely payment; or
  • Engage in conduct detrimental to HubDub or other users.

c. Coaching/Consultancy Programme Termination

Coaching or consultancy agreements may have fixed terms defined in the proposal or statement of work. Early termination may not entitle the Client to refunds unless explicitly stated.

d. Behaviour & Conduct

HubDub reserves the right to cease coaching or consultancy relationships where abusive, harmful, or inappropriate behaviour occurs.

Upon termination, your right to use the Service ceases immediately, and access to data and account features may be removed after a retention period of up to 90 days.

8. Intellectual Property

All intellectual property rights in software, documents, training resources, methodologies, frameworks, templates, and consulting materials remain the exclusive property of HubDub unless explicitly transferred in writing.

Clients receive a licence for their internal business use only and may not share, resell, reproduce, or publicly distribute materials without permission.

9. Acceptable Use

Users must not:

  • Use the Service for unlawful, defamatory, or fraudulent purposes;
  • Upload or transmit malware or harmful code;
  • Infringe third-party rights;
  • Send unsolicited bulk communications (“spam”);
  • Attempt to interfere with or bypass security mechanisms.
  • Misuse of coaching or consultancy sessions (e.g., harassment, inappropriate conduct).
  • Recording sessions without written consent.
  • Sharing confidential training materials externally.

HubDub reserves the right to suspend any account in breach of this clause without refund.

10. Data Protection and Privacy

HubDub complies with all applicable data protection laws, including UK GDPR.Personal data is processed only as described in the Privacy Policy. HubDub acts as a data processor only for administrative account data; all end-user data processed within GoHighLevel remains outside HubDub’s scope.

For coaching and consultancy, personal data shared directly with HubDub (such as business information, documents, and notes) is processed in accordance with the Privacy Policy.

11. Third-Party Services

HubDub integrates with third-party providers such as GoHighLevel and Stripe. Use of those services is subject to their respective terms and privacy policies. HubDub accepts no liability for acts or omissions of third-party providers.

12. Limitation of Liability

To the maximum extent permitted by law, HubDub shall not be liable for:

  • Any indirect, incidental, consequential, or punitive damages;
  • Loss of profits, data, or goodwill;
  • Any interruption, delay, or failure resulting from external systems or third-party services.
  • HubDub provides advice, guidance, and recommendations. The Client remains solely responsible for implementing decisions and actions. HubDub is not liable for business performance, revenue impact, or outcomes arising from the use or non-use of recommendations.
  • Coaching and consultancy are not legal, financial, psychological, therapeutic, or medical services.

HubDub’s total liability arising from or in connection with these Terms shall not exceed the total fees paid by you during the 12 months preceding the event giving rise to the claim.

13. Warranties and Disclaimers

The Service is provided “as is” and “as available” without warranty of any kind, express or implied.

HubDub does not warrant that the Service will be uninterrupted, error-free, or suitable for any particular purpose.

HubDub makes no warranty that coaching or consultancy services will lead to specific business results or outcomes.

14. Indemnification

You agree to indemnify and hold harmless James Craig Consultancy t/a HubDub, its directors, employees, and affiliates against any claims, damages, or expenses arising from:

  • Your use or misuse of the Service;
  • Breach of these Terms; or
  • Violation of any applicable law or third-party right.
  • Claims arising from Client reliance on or misuse of coaching/consultancy advice.
  • Claims resulting from incomplete or inaccurate information provided by the Client during engagements.

15. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of England and Wales.

Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

16. Changes to These Terms

HubDub may amend these Terms periodically. Updates will be posted on hubdub.io/terms with the revised “Last Updated” date. Continued use of the Service constitutes acceptance of any amendments.
